metadata.dc.description.resumo: A tese explora a relação estabelecida entre as concessões historicamente opostas à mulher pela cultura patriarcal e o processo, também histórico, de emancipações femininas. A partir da ocupação da mulher como Sujeito no mundo, sob a perspectiva de gênero, a pesquisa vai ter como foco a praxis feminina no cenário das profissões, quanto à docência e à produção científica, sob a indagação se essas mulheres que alcançaram espaços eminentemente masculinos representam uma emancipação ou se estão diante de mais uma forma simbólica de concessão patriarcal. Para tanto, o trabalho é desenvolvido sob o viés epistemológico do Estruturalismo de Pierre Felix Bourdieu e concentra-se em analisar a disparidade entre os universos feminino e masculino no tocante à atividade docente e científica no campo do Direito, uma vez que os dados oficiais registram uma presença maciça das mulheres dentre os mestres e doutores. A pesquisa foi desenvolvida contando com um estudo historiográfico da mulher na docência jurídica, mais precisamente, da sua participação nos programas de pós-graduação stricto sensu em Direito no Brasil e no Estado do Espírito Santo, de forma a verificar a realidade dessas mulheres no campo das violências simbólicas produzidas no campo jurídico. Assim, tem por objetivo entender o processo de emancipação feminina com foco na teoria do campo jurídico como um campo de poder, de dominação masculina e, sendo um instrumento legitimador do Estado, como um campo detentor do exercício das violências simbólicas. E, enfim, se essa realidade representaria o alcance da emancipação estrutural das mulheres ou se enquadraria, na verdade, em mais uma concessão social, cujo exercício do poder simbólico patriarcal persiste invisível. No tocante ao percurso metodológico, optou-se por uma abordagem quantiqualitativa uma vez que os dados estatísticos apresentados acerca das questões de gênero, ensino e profissões jurídicas, sob a perspectiva da violência simbólica postulada por Bourdieu, precisaram ser analisados também qualitativamente pelo fato de representarem um estudo indissociável dos fatos históricos e sociais.
Abstract: The thesis explores the relationship established between concessions historically opposed to women by patriarchal culture and the historical process of female emancipations. From the insertion of women as a Subject in the world, from a gender perspective, the research will focus on female praxis in the field of professions, concerning teaching and scientific production, under the question of whether women who have reached eminently masculine spaces represent an emancipation or if they are facing another symbolic form of patriarchal concession. For this, the work is developed under the epistemological bias of Pierre Felix Bourdieu's Structuralism and focuses on analyzing the disparity between the female and male universes in relation to teaching and scientific activity in the field of Law, since official data record a massive presence of women among the masters and doctors. The research was developed with a historiographic study of women in legal teaching, more precisely, their participation in the stricto sensu postgraduate programs in Law in Brazil and the State of Espírito Santo, in order to verify the reality of these women in the field of the symbolic violence produced in the legal field. Thus, it aims to understand the process of female emancipation with a focus on legal field theory as a field of power, male domination and, as an instrument legitimizing the state, as a field that holds the exercise of symbolic violence. And, finally, if this reality would represent the reach of women's structural emancipation or would, in fact, fit into yet another social concession, whose exercise of patriarchal symbolic power persists invisible. Regarding the methodological approach, a qualiquantitative approach was chosen, since the statistical data presented on gender, teaching and legal professions, from the perspective of the symbolic violence postulated by Bourdieu, had to be analyzed qualitatively as well because they represented an inseparable study of historical and social facts.
