dc.description.abstractThrough this work, we seek to solve the questioning about the incidence on legal-economic relations involving crypto the Brazilian legal system, using the comparative law the analysis. Theoretical conceptual delimitation of economics aspects digital, being the propeller of the technological innovation of the cryptomoedas. Theoretical conceptual delimitation of what are crypto-coins, especially bitcoin and its functioning. Analysis of the legal treatment given to crypto- jurisdictions, analyzing their legal nature and legal as well as the analysis of the treatment Brazilian legal order to crypto-coins. The development and conclusion of the demonstrate that the legal nature of crypto-coins is hybrid, so as to be determined according to the legal-economic relationship. Consequently, the legal-tax treatment will be given in the same way, that is, in a hybrid way, according to the generating fact manifested through the crypto-coins.pt_BR
dc.description.resumoPor meio deste trabalho, busca-se solver o questionamento sobre a incidência tributária sobre as relações jurídico-econômicas que envolvem criptomoedas no ordenamento jurídico brasileiro, utilizando do recurso do direito comparado para fomentar a análise. Delimitação conceitual teórica dos aspectos relativos à economia digital, sendo esta o propulsor da inovação tecnológica das criptomoedas. Delimitação conceitual teórica do que são as criptomoedas, em especial a bitcoin e o seu funcionamento. Análise do tratamento jurídico dado às criptomoedas por jurisdições estrangeiras, analisando a sua natureza jurídica e as relações jurídicoeconômicas decorrentes delas, assim como a análise do tratamento dispendido pelo ordenamento jurídico brasileiro às criptomoedas. O desenvolvimento e conclusão do texto demonstram que a natureza jurídica das criptomoedas é híbrida, de modo a ser determinada de acordo com a relação jurídico-econômica realizada. Consequentemente, o tratamento jurídico-tributário se dará de igual modo, ou seja, de forma híbrida, de acordo com o fato gerador manifestado através das criptomoedas.pt_BR
