Os inimigos do ministério: o processo histórico de atuação do ministério público à luz de Pierre Bourdieu e da criminologia crítica

Abstract

The present work will have as objective to carry out a sociological approach of the Brazilian Public Ministry. To this end, Pierre Bourdieu's method of analyzing symbolic materialism will be adopted. The focus of the research will be the understanding of the changes of the institution's performance in the Brazilian criminal process, also analyzing how this action is affected by its work in other areas of Law. It will be demonstrated how the institution, through a conscious political project initiated in the years prior to the promulgation of the 1988 Constitution, achieved great successes in the dispute for political and juridical capital in Brazil, becoming a kind of "political agent of law ", and taking a prominent position against the other players in the Law Camp. Finally, the proposals for renewal of the institution's criminal activity will be analyzed in the light of Critical Criminology, for a better understanding of the social effects caused by the institution's exercise of the prosecution power
