O impacto da digitalização na prestação jurisdicional e no acesso à justiça

Abstract

This study aims to examine the right and fundamental guarantee of access to justice from the perspective of technology and a globalized society, analyzing how technology can become an indispensable tool for its implementation as well as a barrier that may lead to social exclusion, making the exercise of this right unattainable not only for the most vulnerable populations due to income constraints but also for judicial employees who have not adapted, resulting in a phenomenon of "digital exclusion." This category includes people who lack internet access or the necessary skills to use new technologies, which hinders the exercise of their basic rights. Additionally, the study will analyze how the Coronavirus pandemic intensified the use of technology, particularly how the judiciary had to adapt in response to this situation. Therefore, this work presents a reflection on the judicial migration process and how it can be a tool capable of expanding access while also potentially excluding certain parts of the population
