dc.description.abstractRonald Dworkin wrote nothing or very little about the fundamental political issues of crime and punishment. This article proposes a Dworkinian reading of such issues. It focuses on two aspects of Dworkin’s work: 1) his criticism of judicial discretion, and 2) his “law as integrity” theory (legislative and adjudicative principle). Integrity of Law in Western legal traditions is examined from a bifurcated approach: on the one hand, in civil law jurisdictions, with a strong culture of legal positivism, the legislative principle is prominent; on the other hand, in common law jurisdictions, statutory provisions are less relevant, and other sources of law prevail (e.g., case law). Building upon Dworkin’s writings, we examine statute-oriented, sentencing models from civil law jurisdictions, and the sentencing guidelines systems from the U.S. and England and Wales. Despite their differences, we set out to find some convergence between both models, aiming at promoting greater integrity at sentencing.pt_BR
dc.description.resumoRonald Dworkin escreveu nada ou muito pouco sobre os fundamentos políticos questões de crime e punição. Este artigo propõe uma leitura Dworkiniana de tais questões. Centra-se em dois aspectos da obra de Dworkin: 1) sua crítica à discricionariedade judicial, e 2) sua teoria do “direito como integridade” (legislativo e adjudicativo princípio). A integridade do direito nas tradições jurídicas ocidentais é examinada partir de uma abordagem bifurcada: por um lado, nas jurisdições de direito civil, com uma forte cultura do positivismo jurídico, o princípio legislativo é proeminente; sobre por outro lado, em jurisdições de direito consuetudinário, as disposições legais são menos relevantes, e outras fontes de direito prevalecem (por exemplo, jurisprudência). Baseando-se em Dworkin escritos, examinamos modelos de sentença orientados por lei do direito civil jurisdições e os sistemas de diretrizes de sentença dos EUA e da Inglaterra e País de Gales. Apesar de suas diferenças, procuramos encontrar alguma convergência entre os dois modelos, visando promover maior integridade na sentença.pt_BR
