Abstract

The present study analyses the national prision issue, mainly the capixaba issue, in reference of the desrespect of the Principle of Human Dignity on prision environment, in reference, obviously, with the prisioners inserted on this environment, as well as the correlation of this problem with the over crowed prisions. At first, the present study will presents the concept definition of the principle referred to. In sequence, will be analysed the ways that the State, with his legislation, effective the perpetuation of the principle reffered to, focused on the legislative texts that seek to assecurate the protection of the Principle of Human Dignity, mainly, the Federal Constution of 1988. Furthermore, this present study analyses the preservation of the principle referred to in prisions, as well as the disposition of the Criminal Enforcement Law about the theme. Also analyses, the current perspective of the national prision system, relating it with the effects of the violence that exist on the actual society as a whole, towards the prision system. Finally, talking about the prisions in Espírito Santo, analyses the actual perspective, comparing the beggining of the past decade, when the state was reported for ONU because of the calamitous situation of the state prisions, as well as the actual conditions of this prisions currently
