dc.description.abstractThe present article has as its object the foundation of the legal system. The central problem is the dichotomy between the idea of transcendence, which for a long time was associated with the banner of jusnaturalism, and the idea of immanence, associated with juspositivism and other areas of scientific knowledge, such as, for example, biology and sociology. The thesis defended here is that the rhetoric of immanence is not a creation of the present day, but a re-reading or rediscovery of a similar idea already existing in ancient Greece.pt_BR
dc.description.resumoO presente artigo tem como objeto o fundamento do sistema jurídico. O problema central é a dicotomia entre a ideia de transcendência, que, por muito tempo, esteve associada à bandeira do jusnaturalismo, e a ideia de imanência, associada ao juspositivismo e a outras áreas do saber científico, como a biologia e a sociologia. A tese aqui defendida é de que a retórica da imanência não é uma criação dos dias atuais, mas sim uma releitura ou redescoberta de ideia semelhante já existente na Grécia Antiga.pt_BR
