dc.description.abstractThis paper aims to present the basic structures of legal rhetoric developed in the second half of the 20th century from a new reading of one of the main authors who enabled a revaluation of rhetoric: Friedrich Nietzsche (1844-1900). Also, the return facing the sources to demonstrate that even the old paths of legal rhetoric, when retraced, can contribute to the advancement of contemporary law. The methodology consists in applying the three senses of rhetoric defined below to clarify the particularities of legal rhetoric with the reflections of Nietzschean philosophy. This is not a theoretical reconstruction of legal rhetoric, but an opening to new perspectives on the same problems of material, analytical and strategic rhetoric under other Luiz Filipe Araújo1lights and shades.pt_BR
dc.description.resumoEste trabalho pretende apresentar as estruturas básicas da retórica jurídica desenvolvida na segunda metade do séc. XX a partir de uma releitura de um dos principais autores que possibilitaram uma revalorização da retórica: Friedrich Nietzsche (1844-1900). Em certa medida, o retorno a uma das fontes para demonstrar que mesmo os antigos caminhos da retórica jurídica, quando novamente percorridos, podem contribuir para o avanço do direito contemporâneo. A metodologia consiste em aplicar os três sentidos de retórica definidos abaixo para esclarecer as particularidades da retórica jurídica em relação às reflexões da filosofia nietzschiana. Não se trata de uma reconstrução teórica da retórica jurídica, mas de uma abertura para novas perspectivas sobre os mesmos problemas das retóricas material, analítica e estratégica sob outras luzes e novos contrastes.pt_BR
